Court hearing underway for Utah's immigration law

SALT LAKE CITY ? Eight months after Utah's immigration enforcement law was put on hold by a federal judge, attorneys on both sides on Friday were arguing the constitutionality of the measure.
The law created by House Bill 497 would have allowed police to check the citizenship of anybody they arrest. It was initially blocked last May by U.S. District Judge Clark Waddoups, 14 hours after it went into effect.
At the time, Waddoups pointed at similarities to a contentious Arizona law that is bound for the U.S. Supreme Court and said there was sufficient evidence that at least some parts of the Utah law would be found unconstitutional.
Waddoups on Friday pressured state attorneys to explain how Utah can justify reaching beyond existing federal laws to make it a crime for an illegal immigrant to enter the state. Justice Department attorneys, meanwhile, were pressed about what would stop the state from requesting information about a person's immigration status.
U.S. Justice Department attorney Josh Wilkenfeld said Utah was attempting to trump federal law by mandating that police officers check the immigration status of anybody booked into jail. He pointed to a 9th Circuit Court of Appeals ruling that struck down a similar law passed in Arizona.
"Cooperation is on federal terms, not as the state defines it," Wilkenfeld said.
Utah's law is much different than the Arizona measure because it gives more discretion to police officers and doesn't allow suspected illegal immigrants to be detained indefinitely, Utah Assistant Attorney General Barry Lawrence said. Instead, the law simply reflects existing federal law and is only meant to ensure that the state can account for criminals who are also illegal immigrants, he said.
"This is not anywhere as invasive as people fear," Lawrence said. "The basic goal is to stop people from committing crimes in the state and quantify how many of those crimes are being committed by illegal aliens."
About 50 people protested the enforcement law outside of the courthouse, and one person was escorted from courtroom after he held up a sign opposing the law.
The American Civil Liberties Union and National Immigration Law Center sued a week before Utah's law went into effect to stop the implementation of House Bill 497, saying it could lead to racial profiling. The U.S. Justice Department joined the lawsuit in November, claiming the measure usurped federal authority.
The Utah law, signed in March by Republican Gov. Gary Herbert, would require police to check the citizenship status of anyone arrested on suspicion of a felony or class-A misdemeanor, while giving authorities discretion to check the citizenship of those stopped for traffic infractions and other lesser offenses. Class A misdemeanors include theft, negligent homicide and criminal mischief, while felonies range from aggravated burglary to rape and murder.
Herbert has maintained the law will eventually be found constitutional.

Swiss craft janitor satellites to grab space junk (AP)
GENEVA ? The tidy Swiss want to clean up space.
Swiss scientists said Wednesday they plan to launch a "janitor satellite" specially designed to get rid of space junk, the orbiting debris that can do serious and costly damage to valuable satellites or even manned space ships.
The 10-million-franc ($11-million) satellite called CleanSpace One ? the prototype for a family of such satellites ? is being built by the Swiss Space Center at the Swiss Federal Institute for Technology in Lausanne, or EPFL.
Its launch would come within three to five years and its first tasks will be to grab two Swiss satellites that were launched in 2009 and 2010 but will be phased out of use, EPFL said.
The U.S. space agency NASA says over 500,000 pieces of spent rocket stages, broken satellites and other debris are orbiting Earth. The debris travels at speeds approaching 17,500 miles per hour (28,000 kilometers per hour), fast enough to destroy or inflict expensive and time-draining damage on a satellite or spacecraft. Collisions, in turn, generate more fragments floating in space.
Space junk has collided with satellites at least twice: In 1996, a French satellite was damaged by a rocket fragment, and in 2009, a satellite owned by U.S.-based Iridium Communications was destroyed in a collision with a derelict Russian satellite.
"It has become essential to be aware of the existence of this debris and the risks that are run by its proliferation," said Claude Nicollier, an astronaut and EPFL professor.
Building the satellite means developing new technology to address three big problems, scientists say.
The first hurdle has to do with trajectory: The satellite has to be able to adjust its path to match that of its target. EPFL said its labs are looking into a new ultra-compact motor that can do this.
Next, the satellite has to be able to grab hold of and stabilize the debris at high speeds. Scientists are studying how plants and animals grip things as a model for what would be used.
And, finally, CleanSpace One then has to be able to guide the debris, or unwanted satellites, back into Earth's atmosphere, where both the Swiss-made satellite and the floating garbage it collects would burn on re-entry.
The Swiss Space Center's director, Volker Gass, said it hopes to someday "offer and sell a whole family of ready-made systems, designed as sustainably as possible, that are able to de-orbit several different kinds of satellites."
It remains to be seen how cost-effective the satellites are since each one would be destroyed after its mission, but governments might provide some funding if governments agree to rules to limit debris.
In 2007, China purposely destroyed one of its own satellites with a missile in a test, putting an estimated 150,000 smaller pieces of debris into space and 3,000 big enough to be tracked by radar on the ground.
More recently, Russia's $170 million planned Mars moon probe got stranded in Earth's orbit after its Nov. 9 launch. Efforts by Russian and European Space Agency experts to bring it back to life failed. It was one of the heaviest and most toxic pieces of space junk ever to crash to Earth.
There have been no reports of anyone ever being hit by it on Earth, but the problem it poses has slowly gained traction in political circles in the decades since the space age began more than a half-century ago.
The European Union has proposed its own draft rules for operating in space and the United States views that document as a starting point.
U.S. Secretary of State Hillary Rodham Clinton warned last month of the space environment is threatened by space junk, and said the U.S. will hold talks with the EU to set informal rules aimed at limiting debris.

Baby Boomers wanted ? New Domesticity

Do you fit in here?
I?m 29, which puts me at the oldest end of Generation Y (for what that?s worth). My mom?s 56, which places her solidly in the Baby Boomer camp. Lately I?ve been talking with some of her same-age friends about New Domesticity, which has been incredibly interesting. A few of them have talked about how they got into hardcore domestic DIY during the 1970s ?back to the land? movement ? making bread and yogurt, sewing their own clothes, etc. ? and see today?s New Domesticity as a close cousin of that movement, complete with the focus on environmentalism and the anti-corporate attitudes. Others seem less comfortable with the idea of ?re-glorifying? the domestic sphere, worried that too much focus on the pleasures of home will keep young women from gaining financial and professional equality with men. Many of these women had to battle hard to achieve their own career goals in an era where women had a steep uphill climb in the workplace, and many of them had to consciously reject their own mothers? 1950s-style homemakerdom in order to do this. Some of these women have been divorced (or seen their friends divorce), and worry that women my age are too cavalier in assuming that their contemporary ?companionate marriages? are divorce- or affair-proof.
It?s also been fascinating to talk to 20- and 30-something women about how their mothers? lives have affected the way they choose to live theirs. A number of women have talked about how seeing the ?crazy stress? or ?constant hurry? of growing up in a two-career family has made them think hard about what really matters to them. This doesn?t necessarily mean they?ve quit their jobs to stay home with their kids (though some have); it might simply mean worrying less about conventional success and more about quality time (say, working a 40-hour week and having time to cook dinner at night rather than working the 60-hour week that might get them a quicker promotion). ?Research bears this out: members of Generation Y (women AND men) are dramatically less likely to define themselves as ?work-oriented? and more likely to define themselves as ?family-oriented? than Baby Boomers.
Though it?s always tricky to make sweeping proclamations about generations, I do think there?s something to the idea that New Domesticity is a reaction ? positive or negative ? to the lives of our own parents. So I?m hoping to talk to some more ?women of Baby Boomer age or older about their feelings on domesticity, work and feminism. If any of you readers out there are, say, 50 or older (or you know someone who is), and would like to chat, drop me a line!

Businesses boosted stockpiles 0.4 percent

WASHINGTON (AP) ? Companies restocked at a faster pace in December, a positive sign that they expect consumers to step up spending.
Business stockpiles grew 0.4 percent in December, the Commerce Department said Tuesday. That followed a similar gain in November. Sales rose 0.7 percent, almost double the November gain.
Companies are building up their stockpiles again after cutting them over the summer amid recession fears. Higher inventories require more production, which boosts economic growth. It also suggests companies expect more sales.
Rising inventories were a key reason growth accelerated in the final three months of last year. Still, some economists expect the restocking to slow this year.
Wholesalers reported a 1 percent increase in inventories. Retailers reported a 0.2 percent gain and manufacturers 0.1 percent.
Inventories rose to a seasonally adjusted $1.56 trillion in December. That is 18 percent above the low point reached in 2009, just after the recession ended.
Rising sales are keeping stockpiles from getting too high. If companies feel their inventories are excessive, they could cut back on orders, slowing the economy.
Overall sales rose in December. Wholesalers reported a 1.3 percent jump in sales, followed by a 0.7 increase for manufacturers and flat sales for retailers. That pushed down the ratio of inventories to sales to the lowest level since March. A lower ratio suggests inventories aren't out of line with sales.

NEW YORK (AP) ? Red is Christie Brinkley's color.
The veteran supermodel is set to return to the runway Wednesday night for the Red Dress Collection fashion show, an annual New York Fashion Week kickoff event that aims to draw attention to women's heart health by putting celebrity catwalkers in a parade of gowns by some of the country's most famous designers.
Brinkley is a supporter of the Heart Truth campaign, headed by the National Heart, Lung and Blood Institute, and has participated in this event before. This year, though, she hesitated before deciding to don a dress again. Her own mother is suffering from serious heart disease, having experienced five strokes and a heart attack, and right now Brinkley says she feels like she should be spending quality time with her parents.
But they're the ones who actually nudged her to do it, she said in a teary telephone interview Tuesday. "My parents understand more than anyone about the importance of getting the right care. They're proud of me that I've reached a place where I can give back."
Something else she's learned from them is to maintain a healthy lifestyle with daily exercise and a careful diet. That wasn't always easy when she was a young model, jet-setting from place to place and trying every fad diet that came along, Brinkley, now 58, said, but she's learned the best way to have the good life is to live it. "I make time for this. I used to always put myself on the back burner, but I want to be strong and able for my kids, myself and my parents."
She said she also finds strength and camaraderie within the modeling world, and she hopes the first-time "models" at the Red Dress show will feel that way, too. "I've always felt the catfight thing is a cliche, but especially when we're all together and subject is the heart, we're all united."
It's also a parade of great dresses, and red looks good on so many people, said Marchesa co-founder Georgina Chapman. Marchesa is once again lending a dress for the event, to be worn by model and actress Rebecca Romijn.
"I love the color red. It's such a passionate color and it's a fabulous color when you want to make a splash," Chapman said. If she were on the catwalk, she said she'd probably wear it probably with black heels or neutral makeup. "There's no matchy-matchy with red," she advised. "I especially love to wear black with a hint of red."
Jenna Elfman, making her Red Dress debut, planned to wear a strapless Alberta Ferretti on the catwalk. "I love fashion, I love performance, I love charity," she said.
She said she has wondered what models think about while they're strutting in front of hundreds of people, but she planned to repeat her mantra of "take big steps."
"Thank God I'm tall," Elfman said. "I will get to the end much faster."
Brinkley's advice to the newbies was simple: "You can't take a bad step when you're on that runway. You're there supporting this worthwhile, meaningful cause. And if you slip and fall, you'll make the news and spread the word even more."
