Cost Concerns Lead California?s Death Penalty Repeal Debate

For Ron Briggs, California?s ballot initiative to repeal the death penalty isn?t just a policy change, but a chance to right the ?ineffective legal beast created by California?s death penalty laws,? which he and his father, then a state senator, helped put in place nearly 40 years ago.

?We thought our 1978 initiative created a system to support victims' families,? wrote Briggs in a Los Angeles Times commentary earlier this year. ?It didn't. The only people benefiting today are the lawyers who handle expensive appeals and the criminals who are able to keep their cases alive interminably.?

Briggs, a self-described conservative who now serves on the Board of Supervisors for El Dorado County and has seen firsthand the ?fiscally ruinous effects? of his initiative, joins a chorus of former death penalty supporters who now say that California?s system is unfixable and should be abolished. In November, California voters will decide whether to approve a constitutional amendment to repeal the state?s death penalty and commute the sentences of current death row inmates to life without the possibility of parole.

Advocates for repeal hope that voters will be persuaded not only by the moral reasons to oppose the death penalty, but also the fiscal ones.

?Voters are shocked when they learn that we are on track to spend $1 billion in 5 years on a broken death penalty,? said Miriam Gerace, communications director for the SAFE California campaign to repeal the death penalty, in an email to Stateline, ?California is broke and voters are ready to have an informed conversation about how we can cut ineffective programs that cost too much and serve no useful purpose.?

A July analysis from the state?s Legislative Analysts? Office found that repealing the death penalty would save the state and counties up to $130 million annually. California has spent about $4 billion on the death penalty system since Briggs? family brought back California?s death penalty in 1978, according to an analysis from Ninth Circuit Judge Arthur Alarcon and Professor Paula Mitchell. And in that time, only 13 people have actually been executed.

But proponents of the state?s death penalty argue that it?s the death penalty opponents that make the system so expensive in the first place, by filing endless appeals and prolonging what they believe should be a shorter process. Those appeals keep death row inmates alive and consuming state resources, and also force families to go through seemingly endless trials for their family members? killer.

?Proponents' born-again fiscal conservatism is hypocritical because they are the ones who have for decades disrupted the system by filing endless legal appeals,? wrote Stephen Wagstaffe, the San Mateo County district attorney, and Marc Klaas, whose daughter was murdered by Richard Allen Davis who now sits on California?s death row, in a San Francisco Chronicle commentary editorial earlier this month.

The anti-repeal advocates recommend the ?mend it, don?t end it? approach recently taken in South Dakota, where the legislature limited death row inmates to one post-conviction appeal, filed within two years of their initial sentencing. They also recommend that appeals courts be allowed to hear death penalty appeals, which currently can be heard only by the state Supreme Court. Those fixes would have to be made by legislation or through later ballot initiatives.

The public is nearly as divided on the death penalty as the two opposing campaigns, according to recent polling. The two sides were in a virtual tie ? 45.5 percent supported repeal, 46.7 percent opposed ? on July 19, one day before the Aurora, Co. shootings. But two weeks after the shooting, the same poll found that only 35 percent of voters favored repeal, while 55 percent supported keeping the death penalty.

Historically, California voters have largely backed the idea of the death penalty, although a 2011 Field poll found that a majority of voters support life imprisonment over capital punishment for first-degree murderers, by a 48 percent to 40 percent margin.

California?s death penalty system is the nation?s largest, with 729 condemned inmates on death row as of this month, according to the California Department of Corrections and Rehabilitation. But it?s not the only state to question the death penalty in the last few years. Connecticut, New Jersey, Illinois and New Mexico have repealed their death penalties in recent years and even in states with the death penalty, fewer death sentences are being handed down.

?This isn?t an out-of-the-blue ballot initiative,? Richard Dieter, executive director of the Death Penalty Information Center, told Stateline. ?It?s a test of which direction California wants to go.?

Here at IFA, the Galaxy Note II's glossy plastic build is practically fading under the ambush of cameras snapping away at Samsung's booth, but clearly this phone is more than just a (super sized) pretty face. As mentioned in our hands-on, Samsung upgraded the original Note's dual-core 1.4GHz chipset to a quad-core 1.6GHz Exynos processor. We put the device to the test today to see how those amped-up insides reflect in the Note II's benchmark scores. As you'll see below, Sammy's latest handset fares significantly better than the original Note and the Galaxy S III.

Oh, what a difference a processor makes. Clearly the step up to a quad-core CPU is to thank for the large performance delta between the Note II and the last-gen Note, though the international version of the Galaxy S III, with a quad-core 1.4Ghz Exynos processor, also falls behind in Quadrant and other tests. The Note II also trumped its Samsung siblings on the browser-focused Vellamo benchmark, which hints at snappier performance on this phone. Things on the graphics side of things look pretty good, too, if the GL Benchmark score is any indication. Our testing got cut short before we could run SunSpider, but we'll add that figure shortly.

Update: We've added SunSpider as well -- the device clocked in at 1,330ms, which is a hair faster than the Galaxy S III.

I admit it, I stink at routine! Some days I manage to get right out of bed and run right through a very productive morning of cleaning and cooking and managing my home.?

Other days I decide to just chuck it all and not worry about it.? Recently I came to realize that my children notice the choices that I make and whether or not I get?my own work completed has an impact on them.

On good days I manage to toss together a snack and fill water bottles for each of them.? I set these things on our counter so that when snack time rolls around I don?t have to worry about what they?ve chosen to eat or how much.? On the days I let routine slide, I find we are scrambling and squabbling over how to get a snack together.

It?s just snack! It takes me all of a minute to dish out.? But doing so ahead of time not only saves me time and grief but it does something else.

It makes my children feel loved, thought of and cared for.

Now I know what you are thinking. My?children are still young.??Six years old and younger to be exact.? How could setting out a snack make much of a difference to them?

But it does.? I realized this a few weeks ago when my four year old, Ezra, asked me why I hadn?t done it in a while.? I just sort of brushed off his question with no real answer.? I mean, how does one describe why they don?t stick to their own routine?? The next day I got it together and had snack ready to go and then I slacked off again.? He noticed and he asked again.? I think he asked me three times over several days before I squatted down and held his little face in my hands and asked him why Mommy making a snack?was so important to him.? And then he said it.? He said the words that?ll crush any Mommy?s heart.? He said, ?Because?you make snack because you love me.?

To him, a snack laid out ahead of time shows love.? I haven?t missed a snack yet.? And I?ve even started dishing up our afternoon snack ahead of time.? I now take special joy in these mundane little tasks.? I started doing it because it made MY life easier.? Now I?ll keep doing it because it makes my son feel loved.?

SEAL's book shows bin Laden raid up close

WASHINGTON (AP) ? A Navy SEAL's firsthand account of the raid that killed Osama bin Laden pulls back the veil on the secret operations conducted almost nightly by elite American forces against terrorist suspects.

Former SEAL Matt Bissonnette's account contradicted in key details the account of the raid presented by administration officials in the days after the May 2011 raid in Abbotabad, Pakistan, that killed the al-Qaida leader, and raised questions about whether the SEALs followed to the letter the order to use deadly force only if they deemed him a threat.

Bissonnette wrote that the SEALs spotted bin Laden at the top of a darkened hallway and shot him in the head even though they could not tell whether he was armed. Administration officials have described the SEALs shooting bin Laden only after he ducked back into a bedroom because they assumed he might be reaching for a weapon.

Military experts said Wednesday that if Bissonnette's recollection is accurate, the SEALS made the right call to open fire on the terrorist mastermind who had plenty of time to reach for a weapon or explosives as they made their way up to the third level of the house where he hid.

Bissonnette wrote the book, "No Easy Day," under the pseudonym Mark Owen as one of the men in the room when they killed bin Laden. The book is to be published next week by Penguin Group (USA)'s Dutton imprint. The Associated Press purchased a copy Tuesday.

For years, the primary weapon in the war on terror has been unmanned drones firing missiles from the sky. But the Bissonnette book reveals a more bloody war waged by special operators, one the public almost never gets to see close up.

The book offers intimate details of a special operations mission. The most memorable scenes are also the most human moments. Bissonnette describes one of the SEALs dressing the wounds of a woman who was shot when she lunged toward the raiders. In another scene, a terrified mother clutches her child, and a young girl identifies the dead man to the SEALs as Osama bin Laden, seemingly unaware of the significance of those words.

In that regard, the bin Laden raid seems destined to become an anachronism. Nearly every top al-Qaida figure killed by the United States since the 9/11 attacks has died in a remote-controlled strike by unmanned drone aircraft ? their deaths seen back in Washington via high-definition video. An estimated 80 top terrorist leaders have been killed in places like Pakistan and Yemen, according to The Long War Journal.com, which tracks such airborne strikes.

Special operations troops often conduct raids similar to the bin Laden strike a dozen times a night in Afghanistan, and previously in Iraq, killing thousands of mostly mid- and lower-level terrorists. It's all part of a war on terror that is winding down and giving way to the drone war outside traditional war zones, given the scheduled drawdown of most U.S. troops in Afghanistan by the end of 2014.

"No Easy Day" shows how routine such operations have become. But the public rarely hears about them. This raid to capture bin Laden, though, was historic.

The SEALS, according to Bissonnette's description, were prepared as they had been in other raids for a gunfight in close quarters, which likely would last only a few seconds, with no margin for error. By the time the SEALs reached the top floor of bin Laden's compound, roughly 15 minutes had passed, giving the terror leader adequate time to strap on a suicide vest or get a gun, he said.

Bissonnette says he was behind the point man going up the stairs in the pitch black hallway. Near the top, he said, he heard two silenced shots fired by the first SEAL into the hallway. He wrote that the SEAL on point had seen a man peeking out of a door on the right side of the hallway, but Bissonnette could not tell from his vantage point whether the bullets hit the target.

The author writes that the man ducked back into his bedroom and the SEALs followed, only to find him crumpled on the floor in a pool of blood with a hole visible on the right side of his head and two women wailing over his body.

Bissonnette says the point man pulled the two women out of the way and shoved them into a corner. He and the other SEALs trained their guns' laser sights on bin Laden's still-twitching body, shooting him several times until he lay motionless.

Once they wiped the blood off his face, they were convinced it was bin Laden.

The SEALs later found two weapons stored by the doorway, untouched, the author said.

National Security Council spokesman Tommy Vietor late Tuesday would not comment on the apparent contradiction between the administration's account and the book's version.

Bissonnette writes that during a pre-raid briefing, an administration lawyer told them that they were not on an assassination mission. According to Bissonnette, the lawyer said if bin Laden did not pose a threat, they should detain him.

"If they didn't feel like there was a threat, they would have captured him," co-author Kevin Maurer told the AP on Wednesday. "But from when they first hit the ground, all the way until they got to the third deck, they had encountered armed men, which made the use of force essential," said Maurer, a former AP reporter.

A former deputy judge advocate general for the Air Force defended the decision to shoot the man the SEALs saw in the hallway.

"In a confined space like that where it is clear that there are hostiles, the SEALs need to take reasonable steps to ensure their safety and accomplish the mission," said the former JAG, retired Maj. Gen. Charlie Dunlap, who now teaches at Duke University law school.

Bissonnette writes that none of the SEALs were fans of President Barack Obama and knew that his administration would take credit for ordering the raid. One of the SEALs said after the mission that they had just gotten Obama re-elected by carrying out the raid. But he says they respected him as commander in chief and for giving the operation the go-ahead.

In an interview scheduled to air Sunday on CBS' "60 Minutes," Bissonnette said the book was "not political whatsoever" and not timed to influence the upcoming national elections. He said it was to commemorate the Sept. 11, 2001, terror attacks and credit those whose work made the mission to get bin Laden a success.

"My worry from the beginning is, you know, it's a political season. This book is not political whatsoever. It doesn't bad-mouth either party, and we specifically chose Sept. 11 to keep it out of the politics. If these ? crazies on either side of the aisle want to make it political, then shame on them."

CBS said Bissonnette was disguised and his voice altered for the interview. The network used only his pseudonym and not his name.

The Pentagon and the CIA, which commanded the mission, are examining the manuscript for possible disclosure of classified information, and could take legal action against Bissonnette.

In a statement provided to the AP, the SEAL author says he did "not disclose confidential or sensitive information that would compromise national security in any way."

The book does include information not previously reported about specific CIA officers' involvement in the raid.

Bissonnette's real name was first revealed by Fox News and confirmed to the AP.

Jihadists on al-Qaida websites have posted purported photos of the author, calling for his murder.

Tom Smith Compares Pregnancy From Rape to Having a Baby Out of Wedlock


Todd Akin may have just met his match in Tom Smith, another Republican U.S. Senate candidate who made controversial remarks about rape this week.

Smith, who was ironically trying to distance himself from the Todd Akin legitimate rape controversy, likened pregnancy from rape to any conception outside marriage.

The Pennsylvanian said that while he condemns Akin's comment, he agrees that abortion should be banned without exceptions, including for rape.

Asked how he would handle a daughter or granddaughter getting pregnant as a result of rape, Smith said he had already "lived something similar to that."

"She chose life, and I commend her for that," he said. "She knew my views. But, fortunately for me, I didn't have to ... she chose the way I thought."

"Don't get me wrong, it wasn't rape." When a reporter asked Smith to clarify what kind of situation was similar, he said, "Having a baby out of wedlock."

Smith added, "Put yourself in a father's position. Yes, it is similar."

Smith's comment comes at an inconvenient time for Republicans, who've been scrambling to distract voters from the firestorm of controversy over Akin.

The Missouri candidate stated that when it's a "legitimate rape" women rarely get pregnant because "the female body has ways to shut that whole thing down."

Smith, who is challenging incumbent Sen. Bob Casey in the November election, told the media that he does not agree with Akin's remark on rape at all.

"He should have never said anything like that," Smith said, though the GOP official abortion position seems to be largely in line with both of theirs.

SAfrican cops: 150 miners claim beaten in custody

JOHANNESBURG (AP) ? South Africa's police directorate of complaints has opened 34 murder dockets in the police killings of 34 striking mine workers and also is investigating complaints that more than 150 arrested miners have been beaten in police custody, the directorate spokesman said Monday.

The news comes as President Jacob Zuma is being grilled by the African National Congress national executive committee over the police shootings that wounded another 78 strikers at the Lonmin PLC platinum mine on Aug. 16.

The killings ? the worst display of state violence since apartheid ended in 1994 ? have shocked the nation and damaged the reputation of Zuma and his governing ANC, already fractured over Zuma's bid for re-election as party president in December. As party president, he would be guaranteed a second term as president of South Africa.

Zuma's enemies say the police shootings highlight what they say is the party's disregard for the poor. The ANC has been unable to stem massive unemployment. Many in South Africa have inadequate housing, lack electricity and access to adequate education and health services.

Spokesman Moses Dlamini said the Independent Police Complaints Directorate has opened dockets investigating 34 murders and 32 attempted murders in the police shootings.

Zuma is reported to have given the order for police to end an illegal and violent strike that began Aug. 10 and had killed 10 people before the shootings, including two police officers hacked to death by strikers who also burned alive two mine security guards.

Police Commissioner Riah Phiyega has faced criticism for telling her officers that they "did nothing wrong." She has said she gave the order to use live ammunition, arguing the police acted in self-defense after they were shot at.

No police officers were hurt when a group of miners charged at them, one seen holding a pistol and others armed with homemade clubs and spears. Police said they recovered six handguns from the scene of the shootings northwest of Johannesburg.

Dlamini refused to comment on local news reports that autopsies show most of the miners were shot in the back as they tried to flee the barrage of police gunfire, though he said the autopsies form part of the directorate's investigations.

He said more than 150 arrested miners have laid complaints that they have been beaten in police custody to get them to implicate their colleagues in the killings of the two police officers.

The miners charge that they were "assaulted with police batons and fists and kicked around, slapped around, some sustained visible injuries to their heads and bodies," Dlamini told The Associated Press.

The police investigation is separate from a judicial commission of inquiry that Zuma has appointed under a retired Supreme Court judge given wide-ranging powers to investigate whether police used appropriate force. The commission will also probe the actions of government officials and the mining company involved.

Lonmin officials reported that only 13 percent of its workers reported for duty Monday ? down from 30 percent on Friday and 50 percent on Saturday ? blaming the stayaway mainly on intimidation. Lonmin has suffered a serious hit to its share price and has said it probably cannot meet debt payments, due next month, because of the strike.

On a rocky outcrop near the mine, about 2,000 strikers and community members gathered on Monday, dancing, singing and repeating their demands for a minimum mining monthly wage of R12,500, up from R5,500 ($1,560 from $690).

At a nearby town, the 256 miners arrested at the scene of the shootings were brought to court to face charges from murder to public violence. Families protested outside the court, calling for their release.

Still reeling from Sunday night's "True Blood" bloodbath finale? Who could blame you? The best villain vamp ever, Russell Edgington, met the True Death, dozens of no-name vampires followed suit and even main man Bill Compton died ... before rising again as the new big bad. And that hardly covers all the action.

Crown prince in charge as Saudi king leaves on holiday

RIYADH (Reuters) - Saudi Arabia's Crown Prince Salman has temporarily taken charge of running the world's top oil exporter for the first time, after the royal court said on Monday King Abdullah had gone abroad for a holiday.

"We deputize, according to our order, Crown Prince Salman to manage state affairs and oversee the interests of the people during our absence from the kingdom," said a royal court statement carried by Saudi Press Agency.

The brief statement did not say where King Abdullah, who is 89, had gone, or how long he was expected to be abroad in a country where the health of senior royals is keenly watched.

Salman was appointed Abdullah's heir in June after the deaths of two crown princes, Sultan and Nayef, in eight months.

The role of crown prince does not just mean Salman would inherit power after Abdullah's death, but makes him the king's deputy in wielding executive power.

Salman, who is also Saudi Arabia's Defence Minister, served as governor of Riyadh province for about five decades. Diplomats say he will likely continue Abdullah's cautious economic and social reforms when he becomes king.

Two weeks ago, King Abdullah appeared in good health hosting a summit conference for Muslim countries in Mecca, where he briefly stood to welcome each arriving leader and chatted between greetings with Iranian President Mahmoud Ahmadinejad.

Senior Saudi royals often holiday outside the kingdom during its sweltering summer months, but Abdullah has in the past also sometimes chosen to stay at his desert farm inside the country.

Saudi Arabia's political system concentrates decision-making in the hands of a few top members of the royal family, meaning the health and movements of the king, crown prince and other senior people are closely watched.

Abdullah had operations for a back complaint in 2010 and 2011.

We are in 6th grade at elementary school in Seoul. You can call us Hansik (??). This means Korea food. We study half the day in Korean and half the day in English at our school. It is private school so we pay for lunch but at public school in Seoul all student get free lunch.

We eat lunch at 12pm everyday in the cafeteria. Everyday there is rice, soup, a main dish, and some side dishes. We can drink water if we want. On some special day there is juice. We have to eat everything before we can go. We can have more food if we want. We don?t like many of the food in the cafeteria. Our favorites are fried chicken and noodle soup.


Today?s lunch was white rice, spinach soybean paste soup (??? ???, sigeumchi doenjangguk), kimchi (?? it is cabbage fermented with spicy red sauce), kim (? dried seaweed), and dwaeji bulgogi (?? ???) was the main dish. Dwaeji bulgogi is pork, spicy red sauce, and cabbage. It is kind of like stiry fry.

Angola's opposition UNITA rallies for democratic vote

Angola's main opposition UNITA party on Saturday rallied thousands of its supporters to demand democratic elections on August 31, only the second peacetime vote in the oil-rich country.

"We call on the National Electoral Commission to respect the law," Isaias Samakuva, president of the National Union for the Total Independence of Angola (UNITA) told the group gathered at a square in the capital Luanda.

Samakuva said he would back the postponement of the vote by a few weeks if it would give the electoral commission time to organise a transparent election.

UNITA has since the start of the year piled pressure on the electoral commission to fix voting irregularities.

He warned that the party would organise a march to the electoral commission's offices if it failed to do so.

Oil refinery blast kills 39 in Venezuela

A massive explosion tore through Venezuela's largest refinery on Saturday, killing at least 39 people and injuring more than 80 in South America's biggest oil producing nation, officials said.

President Hugo Chavez declared three days of national mourning, because the tragedy "affects us all, the great Venezuelan family, civilian and military," he said in a telephone call with members of his cabinet.

Among the dead were 18 members of the National Guard -- who were protecting the state-owned refining facility in the northwestern town of Amuay -- 15 civilians and six unidentified bodies, Vice President Elias Jaua said.

Falcon state Governor Stella Lugo had earlier told official television that one of the victims was a 10-year-old child.

Another 82 people were injured, Health Minister Eugenia Sader said.

Fifteen of the injured remain in hospital and are being evaluated, according to Jaua.

Chavez expressed his sympathy to the families of the dead, urging calm because "fortunately, the greatest danger has been controlled."

Ordering a "thorough investigation," he vowed to help the people who have been displaced from their homes at the refinery complex, which also houses workers and their relatives, and in impoverished neighborhoods nearby.

Energy Minister Rafael Ramirez said the explosion was triggered by a gas leak at the refinery, which is owned by state oil firm Petroleos de Venezuela (PDVSA), the cause of which remained to be determined.

"The gas cloud exploded, igniting at least two storage tanks and other facilities at the refinery," he told VTV television.

Ramirez, who is also president of PDVSA, said the refinery was shut down but operations would resume in two days.

The blast damaged 209 homes and 11 shops, while 13 families saw their homes completely destroyed and were temporarily moved to a naval base, according to preliminary figures.

Firefighters were able to bring the fire under control, though smoke was still billowing from the facility.

While officials said there was no risk of another blast, Jaua noted that response units would "continue fighting the flames all night."

Before the blast, the Amuay refinery, one of the biggest in the world, was able to process about 645,000 barrels of crude oil a day.

Venezuelan media has often reported on complaints about safety and maintenance standards at the country's refineries, which authorities have rarely confirmed.

The Latin American nation produces about three million barrels of oil per day, according to state figures, while the Organization of the Petroleum Exporting Countries puts the number at 2.3 million barrels per day.

OPEC certified in 2011 that Venezuela has the largest oil reserves in the world at 296.5 billion barrels, surpassing Saudi Arabia, the country with the biggest refining capacity.

In March, Venezuelan authorities reported even higher reserves, of 297,570 billion.

Venezuelans are gearing up for October 7 elections, in which Chavez -- Latin America's most influential and outspoken leftist leader for more than a decade -- is seeking a third term.

Opposition candidate Henrique Capriles, the youthful former governor of Miranda state, has trailed Chavez in recent polls by some 15 percentage points.

If Chavez, who has declared himself "free" of cancer a year after his diagnosis, wins and serves out his full term, he could rack up 20 years in office.

Two months out from Election Day, nearly a quarter of all registered voters are either undecided about the presidential race or iffy in their support for a candidate, an Associated Press-GfK poll shows.

These voters could well prove decisive in a close contest. And they will be tough nuts for Barack Obama and Mitt Romney to crack.

Just 29 percent of them have a strong interest in the campaign, compared with 51 percent of those who've made up their minds. So no, they won't be hanging on every word coming out of the national political conventions in Tampa, Fla., and Charlotte, N.C., over the next two weeks.

Who are they? These so-called persuadable voters are more often men than women. They are a bit younger than those who've made up their minds. They have less education and income. And they are far less partisan.

A quarter are independent or unaffiliated, while more than a third consider themselves Democrats and a similar share count themselves as Republicans.

They are folks like Eric Avila, a 35-year-old Democrat from Tampa who didn't vote in 2008, has been unemployed since he was laid off from a sales job four years ago and doubts that either candidate will do much to reduce joblessness.

Avila plans to vote this time but finds the campaign rhetoric from both sides grating. "It kind of gets on your nerves after a while," he says, "all of this stuff a person's promising, and it just gets forgotten or buried under a whole bunch of other things."

Take that, Barack and Mitt. Their challenge is to figure out what will shift people like Avila firmly one way or the other.

Ask the persuadables what will be the single most important factor in deciding their vote, and they have a multitude of answers at the ready.

"Whoever runs the cleanest campaign," says one of those surveyed.

"Whoever has the dirtiest ad campaigns on TV," counters another.

A third, who speaks for many, confesses she has "no idea" what will win her over.

How the persuadables ultimately vote could hinge on which issues rise to the top of the campaign.

Romney holds the advantage among these voters on the economy, creating jobs and the federal budget deficit. But on two issues that have recently grabbed the spotlight ? social issues and Medicare ? Obama is the more trusted candidate among these voters.

Neither Obama nor Romney carries much weight with the persuadables, though: Half have an unfavorable opinion of each candidate.

Count Pam Zickert, an independent from Santa Maria, Calif., among those who are undecided and unenthusiastic.

The 62-year-old retiree dislikes Obama, finds Romney "a bit bland" and has no intention of watching the political conventions.

"It's tough to pick a presidential candidate when none of them are inspiring," says Zickert, who voted for Republican John McCain in 2008.

William Galston, an expert on government and politics at the Brookings Institution and a former Clinton administration official, says that because the persuadables are more difficult to win over, Obama and Romney so far have been more focused on firming up support among their base supporters than on cultivating those on the fence.

Romney's selection of conservative darling Rep. Paul Ryan as a running mate was "a decision to place mobilization ahead of persuasion," he says, and Obama's campaign has been systematically targeting the basic building blocks of his winning 2008 coalition: women, Hispanics, younger voters and gays and lesbians among them.

In a polarized political environment and with limited dollars to spend, says Galston, "you can increase your vote total much more per dollar by ginning up the enthusiasm of the people who are already for you."

Still, in a tight race, the persuadables could ultimately make the difference in key swing states, and they can't be ignored. The campaigns may well spend the convention weeks and September firming up their base supporters, then devote the debates and the final weeks of the race to reaching out to more fickle persuadables.

In the AP-GfK survey, taken Aug. 16-20, the 23 percent of registered voters who are considered persuadable included 7 percent who expressed no presidential preference, 7 percent with soft support for Obama and 9 percent with soft support for Romney. The poll involved landline and cellphone interviews with 885 registered voters, including 192 considered persuadable. The margin of sampling error for registered voters was plus or minus 4.1 percent, and for persuadables 8.9 points.

Will the persuadables actually show up and vote? History suggests yes.

In an AP-Yahoo study that interviewed the same people multiple times over the course of the 2008 presidential campaign, 38 percent of registered voters were persuadable in interviews conducted just ahead of that year's conventions. When that same group was interviewed on Election Day, three-fourths said they had voted.

When will the undecideds make up their minds?

In 2004 and 2008, about 10 percent of voters reported they didn't decide until the last week, according to exit polls.

Michelle Woodby, a 36-year-old Republican homemaker from Tecumseh, Mich., says she's been known to wait until the last minute.

With small kids to care for and little time to watch the news, Woodby says she hasn't fully tuned in yet.

So far, Romney's opposition to abortion has won her over, but Woodby says she's still got a lot of studying to do ? and she shows a decided lack of enthusiasm for the job.

"I need to do my homework," she says, "which I dread."
